From an employment visa to an own-company visa: the order of steps

Licence first, notice second, cancellation third: the sequence that protects residence status, with the notice period, the grace period and the official source for each step.

Updated

Moving from an employer's visa to a visa held through one's own company is a sequence, and the order is the whole job. The costly mistake is to resign and cancel first, then start the company, and discover that the grace period is shorter than the licensing process.

The principle is simple: build the new status before ending the old one. Here is the order, with the official source for each step.

Step 1: read the employment contract

Three clauses decide what is possible while still employed and after leaving.

  • The notice period. Under Federal Decree-Law No. 33 of 2021 on the regulation of employment relationships, either party may end the contract with written notice of at least 30 and at most 90 days, as agreed in the contract; the contract stays valid during the notice period, with full wage (Article 43).
  • The non-compete clause. Article 10 allows an employer to restrict competition after the contract ends, limited in time, place and type of work, for no more than two years. The guide on starting a company while employed covers it in detail.
  • Working for others. Article 16(9) lists among the worker's obligations not to work for others in violation of the law.

Step 2: obtain the licence while still employed and resident

The company comes first, while the employment visa is still valid. This is where the time goes: approvals, documents, the bank account. Free zones set their own document requirements for a shareholder who is employed elsewhere, and some ask for a letter from the current employer. Ask the zone for its current checklist in writing before applying.

Incorporating also starts a tax clock. A company incorporated in the UAE, free zone companies included, must apply for corporate tax registration within three months of incorporation (Federal Tax Authority Decision No. 3 of 2024, effective 1 March 2024). The penalty for late registration is AED 10,000 (Cabinet Decision No. 10 of 2024, Ministry of Finance).

Step 3: register the company as a sponsor

A company cannot sponsor anyone's residence until it holds an establishment card, its registration with the immigration authority. According to the ICP service page for issuing an establishment card, free zone companies submit the request through their free zone authority. The residence visa guide sets out what follows.

Step 4: resign and serve the notice

Written notice now, not earlier. The employment contract, the work permit and the residence visa all continue during the notice period (Federal Decree-Law No. 33 of 2021, Article 43).

Step 5: work permit cancellation, then residence cancellation

The order is fixed by the authorities. GDRFA Dubai's service for cancelling a residence permit requires, for private-sector employees, the Ministry of Human Resources and Emiratisation (MOHRE) work permit cancellation first. The employer handles both.

Step 6: the grace period, and why to plan on the shorter figure

Once the residence permit is cancelled, the holder has a grace period to leave or change status. The two official sources do not state the same figure.

  • ICP, service "Cancellation of residency permits": 180 days for Golden, Green and Blue residence holders and certain other categories, 90 days for skilled workers at levels 1 to 3 and property owners, 60 days for permits issued with a guarantor or host, and 30 days for all other categories.
  • GDRFA Dubai, service "Cancellation of all types of residence permits": a grace period of 60 days.

Both pages were consulted on 21 October 2026. The figure that applies is the one given by the authority that issued the visa, for the visa's category. Plan on the shorter figure until that authority confirms the longer one. Staying beyond the grace period costs AED 50 per day (ICP).

Step 7: the new residence permit through the company

The company applies for its owner's residence permit within the grace period: entry permit or status change, medical examination, Emirates ID biometrics and issue. The residence visa guide describes each step.

If family members are sponsored on the current employment visa, ask the issuing authority how their permits are handled when the sponsor's permit is cancelled, before giving notice. Their timetable must fit in the same window.

The order, in one list

  • read the contract: notice, non-compete, exclusivity
  • licence and corporate tax registration, while still employed
  • establishment card
  • written notice
  • MOHRE work permit cancellation, then residence cancellation
  • new residence permit through the company, inside the grace period
